Charges in Englewood DWI crash that left two dead upgraded

YOU READ IT HERE FIRST: Bergen County Prosecutor John L. Molinelli today confirmed a Friday CLIFFVIEW PILOT report that an Englewood man was drunk when he drove his van into a pole, killing two people, after leaving a Bergenfield bar.

Heriberto Callas is charged with two counts of first-degree vehicular homicide.

Callas was driving a 2004 Mitsubishi Endeavor south on Liberty Road in Englewood just after 2 a.m. Friday when he was unable to handle a curve and the van jumped the sidewalk and smashed into several trees.

Pronounced dead at the scene were Miguel Molina, 23, and Elmer Rodriguez, 32, both of Englewood, Molinelli said. Neither was wearing a seat belt, he told CLIFFVIEW PILOT.

Calles, 50, remains hospitalized at Englewood Medical Center with broken ribs and a punctured lung, the prosecutor said.

Two passengers were taken to Hackensack University Medical Center.

Initial charges that included two counts of death by auto were upgraded following an investigation by Members of Molinelli’s Fatal Accident Investigation Unit (FAIU).

“According to New Jersey law, when a collision caused by the actions of an intoxicated  driver occurs within 1,000 feet of school property, vehicular homicide is a crime of the first degree, punishable by up to 20 years in prison,” Molinelli said, noting that the crash scene is within 1,000 feet of Dwight Morrow High School and the Janis E. Dismus Middle School..             

Calles remains charged with two other counts of assault by auto. Police also gave him motor vehicle summonses for DWI, reckless driving and failure to maintain a lane.  His bail is $300,000 cash.

Calles, of Cottage Place, most recently owned and operated a janitorial service out of Englewood, records show.
